Appellate Law

The Appellate section members are experienced in handling matters in federal and state courts. The firm handles appeals of cases tried by both Abernathy lawyers as well as cases tried by other law firms. Our clients include individuals, and public and private companies, ranging from small companies to publicly held corporations.

Members of the Appellate section are both Board Certified in Civil Appellate Law and Civil Trial Law by the Texas Board of Legal Specialization and are admitted to practice before the United State Supreme Court, the U.S. Courts of Appeals for the Fifth and Eleventh Circuits as well as the Texas appellate courts. Each member of the appellate section is an experienced trial attorney with a unique understanding of the trial process and the potential errors which may result in a successful appeal of an adverse verdict or finding. Each section member has participated in numerous successful federal and state appeals.

In addition to appeals, Appellate attorneys assist clients in many phases of litigation including summary judgment and other critical motions, issues related to preservation of error, jury charge preparation, case analysis and assessment, and pre-trial and post-trial motions and mediation. Our appellate attorneys have experience in the following areas:

  • Administrative Law
  • Bankruptcy
  • Commercial
  • Construction
  • Employment Law
  • Governmental Entities
  • Insurance
  • Oil and Gas
  • Personal Injury
  • Torts
  • Professional Malpractice
  • Real Estate
  • School Law
  • Securities
  • Trusts and Estates
  • Water Law

The firm maintains an emphasis on legal analysis and persuasive writing. The appellate attorneys seek to provide clients with candid counseling about available options and whether those options coincide with a client's needs and goals. Because of their extensive trial experience, the appellate section members are able to converse effectively with the trial lawyers who handled the trial of the matter about the specific technical details which may lead to error which may be raised in appellate argument. Whether assisting before trial with summary judgment motions and jury charges, during trial with error preservation, or after trial with judgment drafting and appellate matters, the appellate section members add significant value to the overall trial of a client's issues.
